第一章 招标公告
招标项目所在地区： 广东深圳
一、招标条件
本项目北极星项目主线圈第2次招标（招标项目编号：CGN-******0001-N1）已通过 审批 ，项目资金来源企业自筹/******有限公司。本项目已具备招标条件，现进行公开招标。
二、项目概况和招标范围
项目概况：本项目为北极星项目所需的主线圈设备。
招标内容与范围：本项目不划分标段，本次招标范围为我方招标文件要求完成的所有零部件的制造、测试和包装运输服务，主要包含以下内容：
1）制造一套230MeV常温等时性回旋加速器主线圈；
2）完成产品生产过程检验及出厂测试；
3）编制招标文件要求的相关技术文件，收集生产过程记录文件等；
4）将通过出厂验收的产品进行包装并运输至采购方指定的交货地点；
最终交付物为按照招标文件第五章技术标准和要求完成装配并检验合格的产品及相关文档。
招标方负责产品的总体设计，并提供外形尺寸图纸和产品技术规格要求，由中标方完成工艺设计并制造出相应产品。
具体招标范围和要求以招标文件第五章技术标准和要求规定为准。
计划交货日期：合同签订后5个月内，最晚到货日期2025年12月30日。
交货地点：招标人指定的中国境内地点。
三、投标人资格要求
- 基本资格：投标人须在中华人民共和国境内（不含港澳台）注册、具有独立法人资格。投标人应通过ISO9001 质量管理体系认证，且处于有效期内。
- 资质要求：无
- 财务要求:******银行资信记录、财务状况良好，不得处于被责令停业、财产被接管或冻结的情形。
- 业绩要求：近5年内（自递交投标文件截止时间起倒算），投标人需具备常温回旋加速器主线圈的供货业绩。投标人须提供业绩清单、合同封面页、供货范围页及签字盖章页、和验收报告(出厂验收报告或到货验收报告）作为证明材料。
- 信誉要求：
（1）未被国家企业信用信息公示系统（******）中被列入严重违法失信企业名单。 （2）未被中国执行信息公开网(******)中列入失信被执行人名单。
- 人员要求：无。
7. 其他要求
（1）本项目 不接受 联合体。联合体注册说明：两个或两个以上普通会员可组成联合体参与投标，由牵头方以联合体的名义登录 ECP 提交联合体会员注册申请，经中广核电子商务平台-供应商服务大厅审核通过后成为联合体会员。
（2）本项目不接受代理商投标。
（3）单位负责人为同一个人的两个及两个以上的企业（公司）；母公司、全资子公司及其控股公司；相互间存在直接控股关系或间接控股关系或管理关系的两个及两个以上的企业（公司）。具备前述情况之一的，只能由其中一家企业（公司）报名申请投标。如出现同时报名的情况，该多名申请人将同时被拒绝参加本项目投标。
（4）对同属一家母公司的各级子公司，但子公司为不同的法定代表人且独立经营，相互间无直接控股关系或间接控股关系，则只能由不超过2家子公司报名参加本项目的投标。如出现多家子公司同时报名的情况，招标人将选择报价最低的2家子公司参加本项目的投标。
（5）其他通用资格要求详见第二章“投标人须知”第1.4款。
四、招标文件的获取
- 获取时间：获取招标文件的开始时间：2025年06月19日 17时00分；截止时间：2025年06月24日 17时30分
2.获取方法：
（1）投标人应在招标文件发售期内在中广核电子商务平台(******)上进行网上投标报名，报名时需填写被授权的投标联系人信息。
（2）本项目招标文件每套售价 0 元。
（3）投标人已注册为中广核电子商务平台会员的，可直接登录报名，否则需先注册为该平台会员后方可报名，注册会员的步骤请详见中广核电子商务平台。如果投标人报名时《营业执照》信息与会员注册时发生变化，请及时登录中广核电子商务平台更新会员注册信息。因投标人未能及时更新注册信息而影响投标的，投标人应自行承担责任。
（4）投标人报名成功后，自行在线下载电子版招标文件，本项目无需上传报名附件。
（5）投标人须在招标文件发售期内完成投标报名工作，逾期系统将自动关闭。未按上述要求进行投标报名并下载招标文件的投标人不得参与投标，招标人有权拒收其投标文件，已收取的，按无效文件处理。
（6）投标人因未按上述要求进行投标报名，投标人应自行承担责任。
（7）保密要求：投标人在标书购买前，应按招标人的要求提供保密承诺函（投标人在报名时需提交保密承诺函，并加盖投标人公章后上传至电子商务平台，承诺函格式详见附件。
五、投标文件的递交
递交截止时间：2025年07月10日 09时00分（北京时间）
递交方法：在递交截止时间前，投标人须在中广核电子商务平台使用数字证书在线加密上传投标文件，提交方式详见招标文件第二章“投标人须知”。
逾期送达的投标文件，中广核电子商务平台将予以拒收。

本项目采用资格后审方式。
- 发布公告的媒介
本招标信息同时在“中广核电子商务平台”(******)及“中国招标投标公共服务平台”（******）上同步发布。
3.电子投标说明
(1)本项目投标报名、招标文件下载、澄清、投标等环节均在中广核电子商务平台在线操作，其中投标环节需使用数字证书。投标人应在投标截止时间前，在中广核电子商务平台在线使用数字证书加密递交可编辑版投标文件。在线加密递交投标文件的功能将在截标时间后关闭。
(2)本项目投标文件的编制均应使用“中广核电子商务平台建设项目_ECP系统投标客管家”，该工具及操作手册已放入中广核电子商务平台的“下载专区”，投标人可自行下载。
(3)投标文件应在指定之处加盖投标人电子公章，对电子公章的维护将向投标人收取费用，收费标准及办理指引在中广核电子商务平台公布。该工具及办理指引已放入中广核电子商务平台的“业务指南”，投标人可自行下载。
(4)投标人已办理原天威数字证书的需要更换为深圳数字证书，且必须在截止时间前办理完毕，否则将影响投标文件的上传。
(5)办理数字证书需要约5个工作日，请投标人合理安排办理时间，逾期影响在中广核电子商务平台递交数字证书加密版投标文件的，后果自负。
(6)关于供应商注册、数字证书的办理以及电子投标工具的使用指南，以中广核电子商务平台首页发布的最新要求为准。

4.重要提示
（1）本项目不接受现场购买招标文件。

（3）为落实国家网络安全等级保护，构建基于国产密码算法应用安全防护体系等相关政策和要求，中广核电子商务平台（ECP）已开展数字证书国密算法升级工作，原RSA算法数字证书将于2022年4月30日起停止使用。2022年5月1日起，未完成数字证书国密算法升级的供应商将无法在ECP进行投标报价等业务，由此造成的后果需供应商自行承担。具体请参阅ECP门户2021年11月17日发布的系统通知“关于开展中广核电子商务平台数字证书国密算法升级工作的通知”，如有疑问，请致电400-112-3838咨询。

保密承诺函
In order to develop the opportunities for the parties to conduct commercial relationship and pursue the common interests of both parties, the parties will consult and discuss, in the course of discussion and consultation, CGN Kingwo Technology Co.,Ltd.（CGNKT）will disclose confidential information to ________________(“the receiving party”), in order to ensure the security and confidentiality of the confidential information and the legitimate rights of both parties, the Receiving Party agree as follows:

1.1.1 All data, information and materials relating to the future or potential business, projects, products, systems, services, technologies, operations, processes, plans, inventions, know-how, designs, software, etc. of CGNKT and its suppliers, subsidiaries, affiliates, customers, directors and shareholders.
与CGNKT及其供应商、子公司、关联公司、客户、董事、股东未来的或潜在的业务、项目、产品、系统、服务、技术、运作、流程、计划、发明创造、技术诀窍、设计，软件等相关的所有数据、信息和资料。
1.1.2 All data, information and materials on the various management systems, operating practices, marketing strategies, competition strategies, pricing strategies, and marketing of CGNKT and its suppliers, subsidiaries, affiliates, customers, directors, and shareholders.
关于CGNKT及其供应商、子公司、关联公司、客户、董事、股东的各种管理制度、操作规范、市场策略、竞争策略、价格策略、市场营销的所有数据、信息和资料。
1.1.3 Information and details about this Letter and business dealings (which have been conducted and are to be conducted).
关于本承诺函及业务往来（已经进行了和拟进行的）的信息和细节。
1.2 Notwithstanding the foregoing, Confidential Information does not include the following information:
尽管存在上述规定，保密信息不包括以下信息：
1.2.1 Information that has been independently developed by the Receiving Party and that the Receiving Party has not violated any laws, regulations or rights of CGNKT, and such information was independently developed by the Receiving Party prior to the Recipient's knowledge of such information from CGNKT in accordance with the terms of this Letter.
接受方已经独立开发的信息，且接受方未曾违反任何法律、法规或侵犯CGNKT的任何权利，并且该等信息是在接受方依照本承诺函条款从CGNKT获悉该等信息之前独立开发的。
1.2.2 Information that the Receiving Party has lawfully possessed before learning from CGNKT in accordance with the terms of this Letter and the Receiving Party shall not be subject to any binding obligation of confidentiality with respect to such information.
接受方在依照本承诺函条款从CGNKT获悉之前已合法占有的信息，且接受方无需对该等信息承担任何具有约束力的保密义务。
1.2.3 is publicly known information and the publicly known status is not due to the fault of the receiving party.
属于公知信息，且公知状态并非由于接受方的过错所导致。
1.2.4 Information obtained by the receiving party from third parties without breaching any of its obligations to CGNKT.

- Use of Confidential Information
保密信息的使用
2.1 The Receiving Party shall ensure that CGNKT's Confidential Information is kept strictly confidential. The Receiving Party may not use the Confidential Information for purposes other than this Contract without the prior written consent of CGNKT, nor may it disclose the Confidential Information to any third party.
接受方应确保CGNKT的保密信息得到严格的保密。未经CGNKT事先书面同意，接受方不得基于本合同以外的目的使用保密信息，也不得将保密信息披露给任何第三方。
2.2 The Receiving Party shall establish and maintain effective security and confidentiality measures to protect the Confidential Information from any breach of this Letter and prevent any knowledge or use of the Confidential Information in breach of this Letter, and in performing the above obligations, the Receiving Party shall take measures not less than those used to protect its own Confidential Information and at its own expense.
接受方应建立并维持有效的安全保密措施来保护保密信息，防止任何违背本承诺函而对保密信息的了解或使用；在履行上述义务时，接受方均应采取不低于保护其自身保密信息所采用的措施，并自行承担相关的费用。
2.3 If the relevant directors, supervisors, managers, officers and employees of the Receiving Party are required by their duties to be informed and process confidential information, the Receiving Party will undertake to instruct such personnel to comply with confidentiality obligations and instruct such persons to enter into a NON-DISCLOSURE LETTER as strict as the terms of this Letter.
若接受方的有关董事、监事、经理、高级职员和雇员其职责要求他们获知、处理保密信息，则接受方将保证指示该等人员遵守保密义务，并责成上述人员签订一份与本承诺函条款同样严格的保密承诺函。
2.4 Confidential information shall not be disclosed to such institutions/persons unless the services of the recipient's professional advisers, suppliers, branches, affiliates, etc. are required to obtain the services of the recipient's professional advisers, suppliers, affiliates, and affiliates for the purposes of this business transaction, and the receiving party shall not disclose confidential information to such institutions/personnel, They shall be required to enter into a NON-DISCLOSURE LETTER that is as strict as the terms of this Letter to ensure the confidentiality of confidential information.
除非为实现本业务往来之目的而必须得到接受方专业顾问、供应商、分支机构、关联机构的服务而由此专业顾问、供应商、分支机构、关联机构必须知晓该等保密信息外，不得向上述机构/人员披露保密信息；并且接受方在向上述机构/人员披露保密信息时，应要求其签订与本承诺函条款同样严格的保密承诺函，以确保保密信息的保密性。
2.5 The receiving party shall not copy or reproduce the confidential information provided by CGNKT, except as necessary for business dealings, and the copy or reproduction shall belong to the property of CGNKT. Even in the above cases, the number of copies shall not exceed the limits necessary for the purposes of this business transaction, and the receiving party shall apply the same or corresponding level of confidentiality to the copies and reproductions as the originals.
接受方不得复印、复制CGNKT所提供的保密信息，除非是因为业务往来所必须，且副本或复制品应属于CGNKT的财产。即使在上述情况下，副本的数量也不得超过符合本业务往来之目的的必要限度，同时，接受方对复印件、复制品应采用与原件相同或相应的保密水平。
- Mandatory Disclosure
强制性披露
Relevant laws, regulations, court orders, government agencies or organizations authorized by laws and regulations require the recipient to disclose confidential information, and the recipient party's disclosure of such information is not subject to this Letter, provided that the receiving party shall immediately notify CGNKT that such confidential information is required to be disclosed.
******法院命令、政府机关或者法律法规授权的组织要求接受方披露保密信息，接受方披露该等信息不受本承诺函的约束，条件是接受方应即时通知CGNKT该等保密信息被要求披露。
- Ownership of Confidential Information
保密信息的所有权
CGNKT reserves all rights and interests in and to the Confidential Information disclosed by CGNKT, and nothing in this Agreement, express or implied, grants to the Receiving Party any proprietary right or title to the Confidential Information, express or implied, except with the written consent of CGNKT.
CGNKT保留对其所披露的保密信息的所有权利和利益，除CGNKT书面同意外，本承诺函的任何规定均未向接受方明示或者暗示授予任何与保密信息有关的任何专有权或所有权。
- Return of documents
文件退还
The Receiving Party shall, within fifteen calendar days of the termination of the business dealings, return to CGNKT all of its Confidential Information and all copies thereof (whether or not it is stored, stored or recorded on computer disks, optical disc readers, optical discs, optical disks, hard disks or software or on paper carriers), and if it is not feasible for the Receiving Party to return such Confidential Information and all copies thereof, the Receiving Party shall destroy it or delete it from a computer or other electronic system.

- Liability for Breach of Contract
违约责任
A breach by a party to this Letter will be deemed to be a breach of contract, and the breaching party shall, in addition to immediately cease the breach, compensate the non-breaching party for the losses suffered as a result. The scope of its compensation losses includes, but is not limited to, the actual losses of non-breaching parties, losses of business opportunities, losses of related rights, reasonable expenses incurred in investigating breaches, and arbitration fees, litigation costs, and attorneys' fees.
协议一方违反本承诺函项下规定的行为将被视为违约，违约方除应当立即停止违约行为之外，还应当赔偿非违约方因此所遭受的损失。其赔偿损失的范围包括但不限于：非违约方的实际损失、丧失商业机会的损失、丧失相关权利的损失、调查违约行为而支出的合理费用以及仲裁费、诉讼费、律师费等。
- Entry into Force and Termination of this Letter
承诺函的生效与终止
8.1 The Receiving Party, undertake and declare on [MM] [DD], [YYYY] (the “Effective Date”) .

8.2 The term of this Letter shall be for Long-term from the Effective Date. The nondisclosure, restricted use and remedial provisions of this Letter shall survive the expiry or termination of this Letter.

- Other conventions

9.1 The Receiving Party may not assign, in whole or in whole, the obligations under this Letter, in whole or in other way, without the prior written consent of CGNKT.
非经CGNKT事先书面同意，接受方不得部分或全部转让或以其他方式转移本承诺函项下的义务。
9.2 If any provision of this Letter is invalid or unenforceable under any law, regulation, rule or other provision, such provision shall be deemed to have been modified or deleted to the extent that it is only required to comply with such law, regulation, regulation or other provision, and the other provisions of this Letter shall continue in full force and effect.
若本承诺函中任何条款按任何法律、法规、规章或其他规定已告失效或无法执行，此条款应视为在仅需符合该法律、法规、规章或其他规定的限度内进行修改或删除，本承诺函的其他条款仍应继续有效。
9.3 The formation, validity, interpretation, performance and dispute resolution of this Letter shall be governed by the laws of the People's Republic of China (except for Hong Kong, Macau Special Administrative Region and Taiwan Region).
本承诺函的订立、效力、解释、履行和争议的解决均应适用中华人民共和国的法律（香港、澳门特别行政区和中国台湾地区除外）。
9.4 Any dispute related to this Letter shall be resolved by both parties through friendly consultation.If the negotiation fails, either party may submit the dispute to the Shenzhen Arbitration Commission for arbitration. The arbitral award shall be final and binding on both parties.
与本承诺函有关的任何争议,双方应通过友好协商解决。协商不成,******委员会进行仲裁。仲裁裁决是终局的,对双方均有约束力。
